Recent EEG studies on the early postmortem interval that suggest the persistence of electrophysiological coherence and connectivity in the brain of animals and humans reinforce the need for further investigation of the relationship between the brain’s activity and the dying process. Neuroscience is now in a position to empirically evaluate the extended process of dying and, more specifically, to investigate the possibility of brain activity following the cessation of cardiac and respiratory function. Under the direction of the Center for Healthy (...) Minds at the University of Wisconsin-Madison, research was conducted in India on a postmortem meditative state cultivated by some Tibetan Buddhist practitioners in which decomposition is putatively delayed. For all healthy baseline and postmortem subjects presented here, we collected resting state electroencephalographic data, mismatch negativity, and auditory brainstem response. In this study, we present HB data to demonstrate the feasibility of a sparse electrode EEG configuration to capture well-defined ERP waveforms from living subjects under very challenging field conditions. While living subjects displayed well-defined MMN and ABR responses, no recognizable EEG waveforms were discernable in any of the tukdam cases. (shrink)

The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

The theme of the meeting was "Buddhists, Christians, and the Doctrine of Creation."Samye Ling, founded in 1967 by Dr. Akong Tulku Rinpoche and now under the guidance of his brother, the Venerable Lama Yeshe Losal, is one of the oldest and largest Buddhist monasteries in Europe. Ven. Yeshe, (...) in welcoming conference participants, told how the monastery has both materially and spiritually reinvigorated what had become a depressed area around the town of Lockerbie in southwest Scotland. Despite the inclement weather, it was thus an appropriate venue for the fifth conference of the European Network of Buddhist-Christian Studies on the topic of creation. As Perry Schmidt-Leukel (Glasgow), who organized the conference, pointed out in his opening remarks, creation in view of ultimate redemption is the quintessentially Christian doctrine. Yet Buddhism certainly did not see samsara as the ultimate reality, and even if the origin of the world was ultimately an unanswerable question, Buddhism too was confronted by the problem of evil.Ernst Steinkellner (Vienna) opened the conference proper with an account of Buddhist critiques of Hindu doctrines of creation. The absolute Brahman was not a creator, but in the course of doctrinal evolution (the masculine Brahman becoming the post-Vedic Brahma) the world came to be seen as the work of a kind of demi-urge, leaving open the question of why. Buddhism, restricting itself to the realm of the finite, mocked Brahmin ideas of the cause of the world, but still had to account for the existence and nature of the world. By the time the Madhyamaka had developed theories of momentary creation, these had become part of the common logic of Buddhists and Hindus.This was followed by a presentation on contemporary Buddhist critiques of creation and creator doctrines by José Cabezón (Santa Barbara), who pointed out certain affinities between modern theories of many universes without beginning or end and traditional Buddhist ideas. Buddhism, he maintained, has an aversion to cosmological uniqueness, whether spatial, temporal, causal, or personal, but it does [End Page 237] regard the causal law of karman as ineluctable. Despite the critiques of Buddhist thinkers such as Gunapala Dharmasiri of Sri Lanka, who are under the misapprehension that Buddhism is on a par with science whereas Christianity is merely religion, this lays the basis for a metaphysics. The site of both suffering and liberation is the cocreativity of all beings. Buddhism is concerned not with being, but with consciousness.Eva Neumaier (Calgary) suggested that in fact Buddhism does have conceptions of creation, but in narrative form, represented in the cosmological structure of the world as the product of the Buddha's meditation rather than as a cosmogony. Creation is not ex nihilo, because nature predates any act of creation, yet the "emptiness" of shūnyatā is also the "swollenness" of fulfilled potential. The Buddha has been represented as the all-creating sovereign, and pure mind has been interpreted as the gender-neutral mother-father of all Buddhas, the "primordial basis." The "original enlightenment" objected to by Critical Buddhism enabled Buddhists to adapt pre-Buddhist ideas such as the Tao, even to the extent of tolerating animistic polytheism.If this presentation surprised some participants, it provided the perfect counterpart to the paper on Christian ideas of creation by John Keenan (Middlebury College). The Jewish and Christian conceptions of creation arise out of events in history, the exodus from Egypt being the originating metaphor. For Christians, liberation from the bondage of sin was the legacy of Israel's tribal warrior God. The Genesis accounts of creation are essentially liturgical, not cosmogonic. Creation is simply assumed as the evidence of divine transcendence; God is not a benevolent parent. The pagan critics who mocked the Jewish and Christian creation stories were just as misguided as the Buddhists who ridiculed the Vedic myths. God was eventually conceived as ipsum esse, the "to be" of things, a nonsubstantialist account that does not purport to answer the question "why." Is it appropriate or even desirable to speak of a Buddhist “theology of religions”? Does Buddhism have its own ways, however subtle, of affirming its superiority over all else that claims the name “religion”?The European Network of Buddhist-Christian (...) Studies set out to find answers to these questions at its seventh conference, held at the splendid Catholic conference center of St. Virgil on the outskirts of Salzburg, Austria.Given the demographic realities in Europe, the network has inevitably tended to be a group of Christians discussing Buddhism, as far as possible with the participation of Buddhist guests but without really providing a platform for a thoroughgoing Buddhist discussion of religious plurality. This time, more Buddhists than ever before, including significant scholars from America and Asia as well as Europe, participated in the conference. We were thus treated to a discussion of Buddhist attitudes to the religions that broke new ground and presented a vivid picture of Buddhism’s own internal diversity.In his introductory address the president of the network, Prof. John May, paid tribute to the University of Salzburg’s newly established Centre for Intercultural Theology and the Study of Religions, whose director, Prof. Gregor Maria Hoff, welcomed participants on behalf of the university. The same pattern is evident in the integration into Buddhism of indigenous religions such as Shintō, which enriched Buddhism but also assimilated it to themselves. Prompted by his contacts with Christian colleagues to venture beyond practice into Buddhist self-reflection, Makransky is now prepared to see in conceptions such as the Dharmakāya (“Dharma body” of the Buddha or ultimate reality) an equivalent of what Christians understand by God. The research was generally motivated by a dearth of studies on joy, and particularly inspired by a book of joy celebrating the inter-spiritual dialogue between the Dalai Lama and Desmond Tutu. Its aim was to investigate whether the direct contemplation of joy would be associated with improvements in psychophysiological coherence, spirituality and various positive emotions and feelings. Integrative quantitative and qualitative findings emerging from a small pilot study, including a convenience sample of six participants with a mean age of (...) 42 years and age range of 25-69 years, supported the research hypothesis. Significant quantitative increases in psychophysiological coherence, spirituality and positive feelings were coherently and consistently supported by participants' individual and collective experiences. Lefebure Fordham University ChristopherIves offers avery clearandthoughtful exploration ofthe relation between Dharma and Destruction. His discussion helps us to understand the historical relation between institutions and violence in various Buddhist traditions. His overview of the historical record is quite compelling, offering us an important counterpoint and corrective to the widespread images of Buddhist peacemakers in the popular media. (...) From the beginning, the Buddhist tradition has had a mixed record in its understanding and practice of the first moral precept, nonviolence. The encounter between Buddhist perspectives and mimetic theory poses interesting challenges for both partners to the discussion. Mimetic theory offers Buddhists an analysis ofthe construction ofdesire and the self that in many ways complements traditional Buddhist perspectives. It also offers a naming ofthe mechanisms of violence in the formation of societies that may be helpful for Buddhists' social analyses. Buddhism for its part offers mimetic theory a centuries-old tradition of reflection on the role of desire in the construction of an illusory self as well as a body of practical wisdom on non-violence that, even if it has not always been put into practice, challenges and instructs the human community today. The popular images of Buddhist peacemakers are, after all, deeply rooted in the early Buddhist tradition and powerfully represented by contemporary figures such as the Dalai Lama, Mahaghosananda (the Patriarch of Cambodian Buddhism and Thich Nhat Hanh (a Vietnamese Zen Buddhist leader who has been nominated for the Nobel Peace Prize). 176Leo D. Lefebure I approach this discussion not as a professional scholar of Buddhism but as a Christian theologian who has been involved in Buddhist-Christian dialogue and who is interested in both Buddhism and mimetic theory, as well as in the relations between these two trajectories today. One model for further discussion would be to take the historical data that Ives has set forth and then apply mimetic theory, asking to what degree mimetic theory can illumine the dynamics and developments of Buddhist history. Using Bernard Lonergan's image of the scissors, which Charles Heflingmentionedin his discussion inthis conference, this approach would cast Buddhism in the role of providing the lower blade of the scissors, the data to be understood, and mimetic theory would provide the upper blade of the scissors, the analytic concepts to understand the data and to make judgments and decisions. In this method, Buddhism would be relatively passive and mimetic theory would be more active. I am sure that there is ample material in Buddhist history that lends itselfto mimetic analysis (one can think ofthe traditional treatment ofthe so-called "outcasts" in Japanese society). One could, as James Alison noted in his opening address, go on endlessly, even obsessively applyingmimetic concepts to different areas of human experience. I am not sure this qualifies as true dialogue, however. It risks continuing the older Orientalist assumption that only Western concepts are capable of understanding Asia's experience and that Asians themselves have relatively little to contribute.1 For a true dialogue, the voices ofboth traditions must play a rather more active role. Both traditions can furnish material for both the upper and the lower blades of the scissors. In Lonergan's terminology, we aremovingbeyondinterpretation, which seeks understanding, and beyond history, which for Lonergan asks what is going forward in history, to the distinct functional specialization of dialectic (Lonergan 125?30). This discipline reflects upon the underlying values at work in historical processes and the assumptions behind these values. In this inquiry we ask about the status of differences of perspective: to what degree are they complementary and where are they contradictory? Buddhists, including the Bhutanese, value human life as rare and precious, and accept sickness, ageing and death as normal aspects of life. However, death and dying are subjects that evoke deep and disturbing emotions often characterised by denial related to high-tech medicalisation and its inspiring hope. Advanced medical interventions such as cardiopulmonary resuscitation are believed to interfere with the natural process of dying. However, some excessively pursue medical interventions in the hope of prolonging and preserving life, refusing its finitude. Healthcare (...) workers are faced with increasing instances of ethical and moral dilemmas exacerbated by inadequate training and lack of proper understanding of the socio-cultural context on end-of-life care and to facilitate good death in Bhutan. We discuss these ethical dilemmas in providing quality end-of-life care and good death against the backdrop of rapidly changing social values and expectations. (shrink)

A review of literature published a decade ago noted a significant increase in empirical papers across nine bioethics journals. This study provides an update on the presence of empirical papers in the same nine journals. It first evaluates whether the empirical trend is continuing as noted in the previous study, and second, how it is changing, that is, what are the characteristics of the empirical works published in these nine bioethics journals. A review of the same nine journals was conducted (...) for a 12-year period from 2004 to 2015. Data obtained was analysed descriptively and using a non-parametric Chi-square test. Of the total number of original papers published in the nine bioethics journals, 18.1% collected and analysed empirical data. Journal of Medical Ethics and Nursing Ethics led the empirical publications, accounting for 89.4% of all empirical papers. The former published significantly more quantitative papers than qualitative, whereas the latter published more qualitative papers. Our analysis reveals no significant difference between the proportion of empirical papers published in 2004–2009 and 2010–2015. However, the increasing empirical trend has continued in these journals with the proportion of empirical papers increasing from 14.9% in 2004 to 17.8% in 2015. This study presents the current state of affairs regarding empirical research published nine bioethics journals. In the quarter century of data that is available about the nine bioethics journals studied in two reviews, the proportion of empirical publications continues to increase, signifying a trend towards empirical research in bioethics. The growing volume is mainly attributable to two journals: Journal of Medical Ethics and Nursing Ethics. This descriptive study further maps the still developing field of empirical research in bioethics. Additional studies are needed to completely map the nature and extent of empirical research in bioethics to inform the ongoing debate about the value of empirical research for bioethics. (shrink)

The use of empirical research methods in bioethics has been increasing in the last decades. It has resulted in discussions about the ‘empirical turn of bioethics’ and raised questions related to the value of empirical work for this field, methodological questions about its quality and rigor, and how this integration of the normative and the empirical can be achieved. The aim of this paper is to describe the attitudes of bioethics researchers in this field towards the use of empirical research, (...) and examine their actual conduct: whether they use empirical research methods, and whether they have made attempts at integrating the empirical and the normative. An anonymous online survey was conducted to reach scholars working in bioethics/biomedical ethics/ethics institutes or centers in 12 European countries. A total of 225 bioethics researchers participated in the study. Of those, 200 questionnaires were fully completed, representing a response rate of 42.6%. The results were analysed using descriptive statistics. Most respondents indicated that they use or have used empirical methods in their work. A similar proportion of respondents reported having had at least some training in qualitative or quantitative methods, respectively. Among the ‘empirical researchers’, more than a fifth had not received any methodological training. It appears that only 6% or less of the ‘empirical researchers’ considered themselves experts in the methods that they have used. Only 35% of the scholars who have used empirical methods reported having integrated empirical data with normative analysis, whereas for their current projects, 59.8% plan to do so. There is a need to evaluate the current educational programs in bioethics and to implement rigorous training in empirical research methods to ensure that ‘empirical researchers’ have the necessary skills to conduct their empirical research in bioethics. Also imperative is clear guidance on the integration of the normative and the empirical so that researchers who plan to do so have necessary tools and competences to fulfil their goals. (shrink)

Background Advances in artificial intelligence, robotics and wearable computing are creating novel technological opportunities for mitigating the global burden of population ageing and improving the quality of care for older adults with dementia and/or age-related disability. Intelligent assistive technology is the umbrella term defining this ever-evolving spectrum of intelligent applications for the older and disabled population. However, the implementation of IATs has been observed to be sub-optimal due to a number of barriers in the translation of novel applications from the (...) designing labs to the bedside. Furthermore, since these technologies are designed to be used by vulnerable individuals with age- and multi-morbidity-related frailty and cognitive disability, they are perceived to raise important ethical challenges, especially when they involve machine intelligence, collect sensitive data or operate in close proximity to the human body. Thus, the goal of this paper is to explore and assess the ethical issues that professional stakeholders perceive in the development and use of IATs in elderly and dementia care. Methods We conducted a multi-site study involving semi-structured qualitative interviews with researchers and health professionals. We analyzed the interview data using a descriptive thematic analysis to inductively explore relevant ethical challenges. Results Our findings indicate that professional stakeholders find issues of patient autonomy and informed consent, quality of data management, distributive justice and human contact as ethical priorities. Divergences emerged in relation to how these ethical issues are interpreted, how conflicts between different ethical principles are resolved and what solutions should be implemented to overcome current challenges. Conclusions Our findings indicate a general agreement among professional stakeholders on the ethical promises and challenges raised by the use of IATs among older and disabled users. Yet, notable divergences persist regarding how these ethical challenges can be overcome and what strategies should be implemented for the safe and effective implementation of IATs. These findings provide technology developers with useful information about unmet ethical needs. Study results may guide policy makers with firsthand information from relevant stakeholders about possible solutions for ethically-aligned technology governance. (shrink)

Precision medicine is an emerging approach to individualized care. It aims to help physicians better comprehend and predict the needs of their patients while effectively adopting in a timely manner the most suitable treatment by promoting the sharing of health data and the implementation of learning healthcare systems. Alongside its promises, PM also entails the risk of exacerbating healthcare inequalities, in particular between ethnoracial groups. One often-neglected underlying reason why this might happen is the impact of structural racism on PM (...) initiatives. Raising awareness as to how structural racism can influence PM initiatives is paramount to avoid that PM ends up reproducing the pre-existing health inequalities between different ethnoracial groups and contributing to the loss of trust in healthcare by minority groups. We analyse three nodes of a process flow where structural racism can affect PM’s implementation. These are: the collection of biased health data during the initial encounter of minority groups with the healthcare system and researchers, the integration of biased health data for minority groups in PM initiatives and the influence of structural racism on the deliverables of PM initiatives for minority groups. We underscore that underappreciation of structural racism by stakeholders involved in the PM ecosystem can be at odds with the ambition of ensuring social and racial justice. Potential specific actions related to the analysed nodes are then formulated to help ensure that PM truly adheres to the goal of leaving no one behind, as endorsed by member states of the United Nations for the 2030 Agenda for Sustainable Development. Structural racism has been entrenched in our societies for centuries and it would be naïve to believe that its impacts will not spill over in the era of PM. PM initiatives need to pay special attention to the discriminatory and harmful impacts that structural racism could have on minority groups involved in their respective projects. It is only by acknowledging and discussing the existence of implicit racial biases and trust issues in healthcare and research domains that proper interventions to remedy them can be implemented. The use of Intelligent Assistive Technology in dementia care opens the prospects of reducing the global burden of dementia and enabling novel opportunities to improve the lives of dementia patients. However, with current adoption rates being reportedly low, the potential of IATs might remain under-expressed as long as the reasons for suboptimal adoption remain unaddressed. Among these, ethical and social considerations are critical. This article reviews the spectrum of IATs for dementia and investigates the prevalence of ethical considerations in the (...) design of current IATs. Our screening shows that a significant portion of current IATs is designed in the absence of explicit ethical considerations. These results suggest that the lack of ethical consideration might be a codeterminant of current structural limitations in the translation of IATs from designing labs to bedside. Based on these data, we call for a coordinated effort to proactively incorporate ethical considerations early in the design and development of new products. (shrink)

In the seven chapters constituting Khedrup Jé's presentation of mind and awareness, he primarily explains the full range of objects, including all phenomena that can be known, and object possessors, things that engage objects, such as consciousness and persons. In the first chapter, Khedrup Jé starts by explaining objects of knowledge. Chapter 2 gives an explanation of various non-valid awarenesses. Chapter 3 explains what it means to be a valid cognizer and divides valid cognizers into various categories. In chapter 4, (...) the first division, valid direct perceivers, is discussed. Chapter 4 further defines the four main categories of direct perceivers: sense direct perceivers, mental direct perceivers, self-knowing direct perceivers, and yogic direct perceivers. In chapter 5, Khedrup Jé gives a brilliant elucidation of this essential teachings of the Buddha. The realizations of the path, explained in chapter 6, are results of valid cognizers. Direct realization of selflessness can only come about by having realized it in a conceptual manner-that is, by generating a valid inference realizing selflessness-first. How to generate this kind of inference is precisely explained in chapter 7. In order to give readers some sense of the two main authors involved here, Khedrup Jé Gelek Palsang and Purbu Chok Jampa Gyatso, whom we mainly rely on for additional explanations, brief biographies of these two eminent Buddhist scholars are given at the close of this introduction. BackgroundThis is the first qualitative study to investigate how researchers, who do empirical work in bioethics, relate to objectives of empirical research in bioethics (ERiB). We explore reasons that make some objectives more acceptable, while others are deemed less acceptable.MethodsUsing qualitative exploratory study design, we interviewed bioethics researchers, who were selected to represent different types of scholars working in the field. The interview data of 25 participants were analyzed in this paper using thematic analysis. ResultsFrom the eight objectives presented to (...) the study participants, understanding the context of a bioethical issue and identifying ethical issues in practice received unanimous agreement. Participants also supported other objectives of ERiB but with varying degrees of agreement. The most contested objectives were striving to draw normative recommendations and developing and justifying moral principles. The is-ought gap was not considered an obstacle to ERiB, but rather a warning sign to critically reflect on the normative implications of empirical results.ConclusionsOur results show that the most contested objectives are also the more ambitious ones, whereas the least contested ones focus on producing empirical results. The potential of empirical research to be useful for bioethics was mostly based on the reasoning pattern that empirical data can provide a testing ground for elements of normative theory. Even though empirical research can inform many parts of bioethical inquiry, normative expertise is recommended to guide ERiB. The acceptability of ambitious objectives for ERiB boils down to finding firm ground for the integration of empirical facts in normative inquiry. (shrink)

Ensuring confidentiality is the cornerstone of trust within the doctor–patient relationship. However, health care providers have an obligation to serve not only their patient’s interests but also those of potential victims and society, resulting in circumstances where confidentiality must be breached. This article describes the attitudes of mental health professionals when patients disclose past crimes unknown to the justice system. Twenty-four MHPs working in Swiss prisons were interviewed. They shared their experiences concerning confidentiality practices and attitudes towards breaching confidentiality in (...) prison. Qualitative analysis revealed that MHPs study different factors before deciding whether a past crime should be disclosed, including: the type of therapy the prisoner-patient was seeking, the type of crime that is revealed, and the danger posed by the prisoner-patient. Based on this study’s findings, risk assessment of dangerousness was one of the most important factors determining disclosures of past crimes, taking into consideration both the type of therapy and the crime involved. Attitudes of MHPs varied with regard to confidentiality rules and when to breach confidentiality, and there was thus a lack of consensus as to when and whether past crimes should be reported. Hence, legal and ethical requirements concerning confidentiality breaches must be made clear and known to physicians in order to guide them with difficult cases. (shrink)

Background: This article describes the overall attitudes of children, their parents, and attending physicians toward including or excluding pediatric patients in medical communication and health care decision-making processes. Methods: Fifty-two interviews were carried out with pediatric patients (n = 17), their parents (n = 19), and attending oncologists (n = 16) in eight Swiss pediatric oncology centers. The interviews were analyzed using thematic coding. Results: Parenting styles, the child's personality, and maturity are factors that have a great impact upon the (...) inclusion of children in their health care processes. Children reported the desire to be heard and involved, but they did not want to dominate the decision-making process. Ensuring trust in the parent–child and physician–patient relationships and respecting the child as the affected person were important values determining children's involvement. These two considerations were closely connected with the concern that fantasies are often worse than reality. Seeking children's compliance with treatment was a practical but critical reason for informing them about their health care. The urge to protect them from upsetting news sometimes resulted in their (partial) exclusion. Conclusions: The ethical imperative for inclusion of children in their health care choices was not so much determined by the right for self-determination, but by the need to include them. If children are excluded, they imagine things, become more isolated, and are left alone with their fears. Nevertheless, the urge to protect children is innate, as adults often underestimate children's coping capacities. (shrink)

In this article we critically examine the principle of equivalence of care in prison medicine. First, we provide an overview of how the principle of equivalence is utilized in various national and international guidelines on health care provision to prisoners. Second, we outline some of the problems associated with its applications, and argue that the principle of equivalence should go beyond equivalence to access and include equivalence of outcomes. However, because of the particular context of the prison environment, third, we (...) contend that the concept of “health” in equivalence of health outcomes needs conceptual clarity; otherwise, it fails to provide a threshold for healthy states among inmates. We accomplish this by examining common understandings of the concepts of health and disease. We conclude our article by showing why the conceptualization of diseases as clinical problems provides a helpful approach in the delivery of health care in prison. (shrink)

Problems arise when applying the current procedural conceptualization of decision-making capacity to paediatric healthcare: Its emphasis on content-neutrality and rational cognition as well as its implicit assumption that capacity is an ability that resides within a person jeopardizes children’s position in decision-making. The purpose of the paper is to challenge this dominant account of capacity and provide an alternative for how capacity should be understood in paediatric care. First, the influence of developmental psychologist Jean Piaget upon the notion of capacity (...) is discussed, followed by an examination of Vygostky’s contextualist view on children’s development, which emphasizes social interactions and learning for decision-making capacity. In drawing parallels between autonomy and capacity, substantive approaches to relational autonomy are presented that underline the importance of the content of a decision. The authors then provide a relational reconceptualization of capacity that leads the focus away from the individual to include important social others such as parents and physicians. Within this new approach, the outcome of adults’ decision-making processes is accepted as a guiding factor for a good decision for the child. If the child makes a choice that is not approved by adults, the new conceptualization emphasizes mutual exchange and engagement by both parties. (shrink)
